WAIVER & RELEASE AGREEMENT

LIABILITY WAIVER & RELEASE

I am the Participant, or parent or legal guardian of each minor child (“Participant”) identified on this Covid19 Waiver & Release is participating in "A Sports Program Activity" hosted by So Cal Fierce Basketball or "SCF" voluntarily and at our own risk, and understand and agree to the following:

COVID19 ACKNOWLEDGEMENT WAIVER & RELEASE

COVID-19 is a virus with no known cure, and is highly contagious. So Cal Fierce Basketball undertakes every effort to protect participants in athletic activities, including COVID-19 at home screenings and testing location resources, social distancing measures, and a sanitization station at all practices, games and events and activities to minimize the risk of exposure to and transmission of COVID-19. However, we cannot guarantee that those efforts will prevent the transmission of COVID-19 while on campus and/or participating in So Cal Fierce Basketball sponsored athletic activities. So Cal Fierce Basketball host athletic activities in recognition that such activities can promote and enhance the mental and physical health and well-being of its participants, but encourages students athletes and parents to seriously consider the potential risks of such participation as a result of COVID-19.
I/We can be exposed to or contract COVID-19 while participating in So Cal Fierce Basketball-sponsored athletic activities. I have read and understood the above warning concerning COVID-19. I/We choose to accept and assume the risk of contracting COVID-19 to participate in So Cal Fierce Basketball-sponsored athletic activities. These athletic activities are of such value to me that I accept and assume the risk of being exposed to, contracting, and/or spreading COVID-19 in order to participate in these activities. I/We understand that if I/We are not comfortable or cannot agree to execute this Waiver/Release then I/We may not participate in So Cal Fierce Basketball-sponsored athletic activities.
I/We hereby expressly waive, and release So Cal Fierce Basketball, its members, employees and agents, from any and all rights, claims, lawsuits or damages of any nature whatsoever arising directly or indirectly from COVID-19 infection or transmission related to my participation in a So Cal Fierce Basketball-sponsored athletic activities. I understand that this waiver means I give up my right to bring any claims, including for personal injuries, death, disease, or any other loss, including but not limited to claims of negligence, and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. I understand and agree that this waiver and release is intended to be interpreted broadly in favor of So Cal Fierce Basketball.
Also, this Waiver/Release shall apply to any and all So Cal Fierce Basketball-sponsored athletic activities occurring from the date below until December 31, 2021, or revoked in writing by Participant, whichever date is earlier. Revocation of this Waiver/Release shall not affect any rights of So Cal Fierce Basketball et al. with respect to athletic activities occurring prior to such revocation or termination and is intended to survive revocation or termination of this Waiver/Release.
I/We attest that I/We are 18 years or older and if any minor child is identified on this form, that I/We are the parent or legal guardian of such minor child.

GENERAL WAIVER & RELEASE

Assumption of Risks: I acknowledge and represent that I am familiar with the significant risks and dangerous nature which originate from participating and otherwise engaging in athletic activities, including, but not limited to basketball. I hereby, as a parent and/or participant acknowledge, accept and assume any and all responsibilities and liabilities pertaining to such risks, whether to myself or to others and without limitation or qualification. There have not been any express or implied representations to you on behalf of “SCF” except as set forth in this Agreement.
Statement of Participant’s Good Physical Health: I acknowledge that at the time of signing this Agreement as the parent of the participant attest that the participant is in sufficient physical and mental condition to engage in basketball and other strenuous activities. And that, will not in any way adversely limit Participant’s ability to engage in programs, clinics, practices, services or games offered or coached by “SCF” which are rigorous and physically demanding.
Photo & Video Release: I  hereby give permission to “SCF” and it’s partner Great Gain Athletics Inc (a not-for-profit organization) to photograph, record and use photographs, voice recordings or video taken of me and or the above listed minor by “SCF” and/ or associated staff or hired contractor of me during the practices, games, team and community events associated with “SCF” in any manner to help promote the program, programs mission and services as well as other activities and events as determined in the sole discretion of “SCF” and it’s partnering organization, Great Gain Athletics Inc. Such use could include publications, media releases, announcements, electronic or otherwise, and on league websites or social media pages. I agree that neither I, nor the above listed minor will receive any compensation if such an image appears in any of the manners listed above or any other manner that the So Cal Fierce Basketball Program or partner organization, Great Gain Athletics Inc deems appropriate. I agree that such images and recordings are the property of So Cal Fierce Basketball Program and/or it’s partnering organization, Great Gain Athletics Inc.
Disclaimer and Waiver of Liability [ Program or Activity ]: “SCF”, as well as its principals, employees and affiliates, are not and will not be responsible for any injury or death arising from or related to participation in programs or activities where the risk of such injury or death has been recognized and acknowledged by Parent and Participant by Parent’s signing of this Waiver. Parent and Participant release “SCF”, including its principals, employees and affiliates, from liability for injury or death arising or resulting from any such risks or activities. “SCF” and its principals, employees and affiliates are not and will not be responsible for any damage or loss of personal property suffered by Parent or Participant engaged in any sponsored including travel to and from team related activities or offered programs except by gross negligence.
Disclaimer and Waiver of Liability [ Gym, School or location]: Any gym, school or location, as well as its principals, employees and affiliates, are not and will not be responsible for any injury or death arising from or related to participation in “SCF” programs or activities where the risk of such injury or death has been recognized and acknowledged by Parent/Guardian and Participant by Parent’s/Guardian’s signing of this Waiver. Parent and Participant releases any gym, school or location, including its principals, employees and affiliates, from liability for injury or death arising or resulting from any such risks or activities or from any other use of premises or facilities in connection with any gym, school or location “SCF” programs and activities. Any gym, school or location and its principals, employees and affiliates are not and will not be responsible for any damage or loss of personal property suffered by Parent/Guardian or Participant engaged in any sponsored or offered program or activity including, but not limited to any other location, except by reason of gross negligence.
Comprehensive Release: I do hereby, on behalf of myself and my heirs executors, administrators, assigns and legal and personal representatives, unconditionally and irrevocably release and discharge the "SCF", the "SCF"’s successors, assigns, owners, shareholders, directors, officers, employees, agents, representatives, attorneys, independent contractors, subsidiaries, and affiliates and each, every and all persons acting by, through, under or in concert with any of them (collectively, “Released Parties”). I further do hereby on behalf of myself and my heirs, executors, administrators, assigns and legal and personal representatives agree not to sue, or otherwise initiate legal, equitable or similar action or to otherwise file a complaint or other action for controversy resolution or otherwise seek losses, costs or expenses of any nature whatsoever, known or unknown, suspected or unsuspected, fixed or contingent, including without limitation, all personal injuries, known or unknown, and death and/or personal injuries to third parties, and injuries to property, real or personal, known or unknown, against any of the Released Parties, caused by any reason whatsoever related to the "SCF" and my activities on or about the "SCF"’s premises and/or facilities. This Release shall pertain to any claims which were known or unknown, anticipated or unanticipated at the time of the execution of this Agreement, including any information of any nature which, if known by me on the date of execution of this Agreement, may have materially affected my decision to execute this Agreement and specifically this Release

By signing this waiver and release, I acknowledge that I have read, understood, and agreed to the provisions set forth above. In addition, my signature below indicates that I have read this entire Agreement, understand it completely, and agree to be bound by its terms. If this Agreement is being executed by me as a legal guardian on behalf of a person under the age of 18 years, then all provisions of this Agreement shall pertain to the undersigned and the Minor.

In order to make sure we remain compliant with all laws governing children at play, including but not limited to, league and tournament requirements, Santa Monica Unified School District requirements in conjunction with city and state mandated Covid19 laws acknowledgements, waivers and notices, we need to keep on file signed and/or required documents relevant to youth in sports. *

Practices are usually Mondays & Fridays, Clinics on Wednesdays and beach workouts on Sundays unless we have games.Please contact us directly at socalfierceball@gmail.com If you are signing up after the 2nd week in the current billing month and would like to request a prorated amount for the So Cal Fierce Youth Basketball Program (Monthly). You can request a prorate registration code via email before completing your registration on the payment page. Otherwise, it will be applied to the next month’s payment with a registration code sent to your primary email address. Once you receive your code, enter it in the registration code box on the next page and click apply to reveal your prorated amount for the current month. Please note, this code does not apply or work for Single Day Session.
